Baptist Health Sys. v. Rutledge

The Supreme Court of Arkansas ruled that a hospital’s challenge to a state law governing peer review was not capable of being reviewed by the courts because there was no “justiciable controversy.”  Because there was no “actual, present controversy” between the parties, the supreme court dismissed the appeal.
