U.S. ex rel. Manion v. St. Luke's Reg'l Med. Ctr., No. CV 06-498-S-EJL (D. Idaho Mar. 31, 2008)
The United States District Court for the District of Idaho denied a hospital's motion to dismiss claims made by qui tam relators under the False Claims Act. The court found that the relators pled, with sufficient particularity, the alleged fraudulent activities, including the who, what, when, where and how. Additionally, the relators alleged a wrongful retaliation claim. Although the relators were still employed with the hospital, they met the requirements for making a claim for retaliation because they had been excluded from corporate and planning/training meetings.
