The United States District Court for the District of South Carolina denied summary judgment on a physician's claims against a nonprofit, community-based primary care center alleging retaliation under Title VII of the Civil Rights Act of 1964 and violation of the state's Wage Act, holding: (1) the physician defeated the question of whether she had exhausted the administrative remedies with her assertion that she was being "forced out" of her employment contract and had been informed that she would only remain employed if she withdrew her complaints; and (2) unexplained discrepancies in the calculation of the physician's net production figures were sufficient to avoid summary judgment on the physician's Wage Act claim for unpaid productivity bonuses.
