Adena Reg'l Med. Ctr. v. Leavitt, No. 07-5273 (D.C. Cir. May 30, 2008)

The United States Court of Appeals for the District of Columbia Circuit reversed a lower court's ruling which had allowed hospitals in Ohio, operating under the Hospital Care Assistance Program ("HCAP"), to include beneficiaries of that program in calculating money due to Medicare disproportionate share hospitals. Interpreting applicable provisions of the Medicare and Medicaid statutes, the appeals court concluded that since the beneficiaries of HCAP were not eligible for assistance under Medicaid, they could not be counted when calculating monies due the hospital under Medicare.
