Certificate of Need

The District Court of Appeal of Florida held unconstitutional a Florida statute that created an exemption from a Certificate of Need requirement for the creation of an adult open heart surgery program in one special circumstance. The court found that the statute was specially created for one hospital’s situation and could not be applied to any other hospital in Florida.
