Provenzano v. Thomas Jefferson Univ. Hosp., No. Civ.A.02-6584 (E.D. Pa. March 20, 2004)
The United States District Court for the Eastern District of Pennsylvania ruled that a hospital did not violate the Americans with Disabilities Act or the Pennsylvania Human Relations Act when it terminated a surgical resident who had carpal tunnel syndrome. The court noted that the resident, who was limited in his ability to grasp, write, and perform manual tasks with his hand, could not perform the essential functions required of the orthopedic surgery residency. Moreover, the hospital had made reasonable efforts to accommodate the resident by holding his position open for eight months while he attempted to rehabilitate his hand.
