Pitts v. Phoebe Putney Mem'l Hosp., Inc., No. A06A0234 (Ga. Ct. App. June 6, 2006)

A group of patients alleged that a nonprofit hospital, which charges uninsured patients more than it charges patients insured by Medicare or Medicaid, was operating in violation of state law and in breach of contract and fiduciary duty. The appellate court affirmed the lower court's dismissal of the suit, relying entirely on the reasoning set forth in Cox v. Athens Regional Med. Ctr.
