Joseph v. Tenet Healthsystem North Shore, Inc., No. 3D05-2577 (Fla. App. Mar. 14, 2007)

The District Court of Appeal of Florida affirmed a lower court’s summary judgment for a hospital, holding that a hospital is not liable where a staff physician fails to satisfy a monetary judgment entered against him. The court noted that Florida statutes “necessarily relieve hospitals of any liability if its physicians who, though initially agreeing to be personally liable, are ultimately unable to pay any subsequent judgments.”
