Hill v. E. Baton Rouge Parish Dep't of Emergency Med. Servs., No. 2005 CA 1236 (La. Ct. App. Dec. 22, 2005)
The Court of Appeal of Louisiana upheld a
trial court decision finding the substance of EMS calls to be protected from
disclosure. The court held that EMS calls are protected by HIPAA (since they
contain protected health information) and the Louisiana Code of Evidence
(which grants patients the privilege to disclose information regarding their
health).
