E. Portland Imaging Ctr. v. Providence Health Sys.-Or., No. CV 05-465-KI (D.Or. Mar. 21, 2006)

The United States District Court of the District of Oregon granted a health system's motion for summary judgment in an antitrust case filed by a competing radiology center. The radiology center alleged that the health system attempted to monopolize the outpatient diagnostic imaging market by opening two outpatient imaging centers and by terminating the radiology center's contract with the system's health plans. While the district court found there was evidence of anticompetitive conduct by the health system, it also found that the radiology center failed to demonstrate there was a dangerous probability of the health system achieving monopoly power, and granted summary judgment in favor of the health system.
