CONTRACT DISPUTE
Cmty. Mem'l Hosp. v. Mattar, No. L-05-1049 (Ohio Ct. App. Jan. 6, 2006)
The Court
of Appeals of Ohio determined that an arbitrator exceeded the scope of his
authority by imposing additional terms when interpreting a physician's employment
contract. The arbitrator found that although the physician had violated a provision
of his contract, the hospital's decision to terminate the physician was additionally
motivated by economic considerations. The court found that this decision,
and the related award to the physician, was not based on the essence of the
contract language.
