BREACH OF CONTRACT

A group of emergency physicians entered into a contract with an administrative and management service, whose responsibilities included providing professional liability insurance. When the service failed to furnish both claims-made and occurrence policies, the physicians brought suit alleging breach of contract and breach of fiduciary duty, as well as deceptive and unfair trade practices. The service sought to dismiss all counts of the complaint for failure to state a claim, but the United States District Court, Middle District of Florida found that all the physicians' claims were sufficiently supported to meet the well-pled complaint standard.
