Anonymous v. Bureau of Prof. Med. Conduct,
No. 16646 (N.Y. App. Div. Sept. 11, 2003)

A statement of charges based on multiple allegations of misconduct was filed against a physician by the New York State Board for Professional Medical Conduct. Although only one charge was sustained by a hearing committee, which was described as a "one-time technical violation," the Department of Health published information on all of the charges on its website, including the unsustained charges. The physician argued that the information on the unsustained charges should be removed and the court agreed, ruling that those charges should remain confidential.
