The
Commonwealth Court of Pennsylvania upheld the decision of the Board of Medicine
to revoke a physician's medical license based on his conviction of six counts
of sexual assault on patients during office visits. The Board had previously
stated that "even a single incident of sexual abuse of a patient warrants
the stringent sanction" of license revocation. Furthermore, the Board did
not commit harmful error or reflect bias when it described the physician as
a "sexual predator," which was done only in response to the physician's
claim that the Board was discriminating against him because he is a native of
Afghanistan. The Board had merely stated that it "consistently imposes
severe sanctions on sexual predators, without regard to their age, race, religion,
or ethnicity."
