In
a Medicare and private insurance fraud action brought against a management company
operating a hospital, and several of the hospital's employees and physicians,
the United States District Court for the Northern District of Illinois excluded
evidence that two patients died while undergoing allegedly unnecessary angioplasties.
The court found that evidence of the deaths was not necessary to prove the fraud
claim and would unnecessarily prejudice the jury.
