The
New York Supreme Court, Appellate Division, reviewed a determination by the
state Administrative Review Board for Professional Medical Conduct revoking
an emergency room physician's license to practice medicine in New York. The
appeals court ruled that the Board's findings of gross incompetence were well
supported by evidence that he failed to obtain proper patient histories, performed
inadequate examinations, failed to order appropriate lab tests and misdiagnosed
conditions that should have been easily recognized. The Board's findings of
fraudulent practice were supported by evidence that he knowingly withheld information
on applications for medical staff appointment.
