The
Kentucky Court of Appeals held that a medical center did not violate its bylaws
by excluding a radiologist who was an honorary staff member from a medical executive
committee meeting and having him escorted from the room by security. The medical
center subsequently revoked the physician's honorary staff appointment, and
denied his request for a hearing or appeal regarding the revocation.
The Appeals Court concluded that the medical center's bylaws were not violated by the exclusion of the physician from the MEC meeting, because the section of the bylaws in question, providing that honorary staff members "may attend Medical Staff and department meetings, including committee meetings" did not include medical executive committee meetings.
