Slobin v. Henry Ford Health Care,

The Court of Appeals of Michigan allowed a patient to go forward in his action against a health system, in which he claimed that the system violated the state Consumer Protection Act by charging an excessive amount for copying his medical record. The patient showed that the vendor with whom the hospital contracted to provide copies of medical records charged double the amount charged by 17 nearby hospitals. In the absence of any explanation for the heightened fee, the court found that there was an issue of fact over whether the charge was grossly excessive, and thus in violation of the statute.
