The
United States District Court for the Western District of New York allowed a
medical resident's Title VII sexual discrimination and harassment claim against
her employing hospital to go forward, despite the fact that the claim was filed
with the EEOC more than 300 days after the discriminatory act occurred. The
court noted that the resident had actively pursued her claim with the EEOC,
but the EEOC inappropriately delayed the processing of her "new charge
questionnaire." Accordingly, the court found the resident to be entitled
to equitable tolling of the limitations period.
