Care Choices HMO v. Engstrom,

A Medicare HMO sued an enrollee in federal court to recoup medical expenses it had paid to her after she settled a slip and fall lawsuit against a supermarket. The federal district court granted the enrollee's motion to dismiss, ruling that it did not have subject matter jurisdiction. The United States Court for the Sixth Circuit affirmed, rejecting the HMO's argument that the court had jurisdiction based on the federal statute which permitted the Centers for Medicare & Medicaid Services to contract with private HMOs to provide replacement coverage for Medicare-eligible individuals.
