For decades, sexual harassment and discrimination have been unlawful – and substantial legal judgments against hospitals (and sometimes physicians) have not been unheard of. But, experience has taught us that the threat of legal action has not been sufficient to eradicate these forms of discrimination. At least not for Medical Staffs.
But, hospitals’ recent struggles to find and retain direct care staff might finally provide the additional motivation necessary for real change. Anecdotal evidence suggests that complaints of discrimination are experiencing an uptick. Because behavior is worse? Maybe. But, more likely, because staff are no longer afraid to speak up. They know they have options.
What can your organization do to respond? How can you not only stay on the right side of the law, but also ensure that your workplace is seen as desirable and welcoming? Learning Objectives
Upon completion of this audio conference, participants should be able to:
- Understand the importance of managing sexual harassment by Medical Staff members – and understand the legal and practical implications of failing to do so;
- Develop Bylaws and/or policy language outlining both Medical Staff committees and Medical Staff responsibility for preventing and addressing sexual harassment and discrimination within the Medical Staff; and
- Distinguish between harmless joking or gracious compliments from comments and conduct that violate the civil rights laws of the United States of America.
