  • How can “he said, she said” concerns be investigated where there are no witnesses to the alleged bad conduct?
  • What happens to documentation if an allegation cannot be substantiated? What happens to such documentation – and the person who raised the concern – if the allegation is proven to be false?
  • What happens if a consensual relationship leads to a concern about sexual harassment?
  • Should a reported concern of sexual harassment by an office receptionist about her physician employer be reviewed at the hospital?

  1. Identify strategies for preventing and responding to potential concerns about sexual harassment and other behaviors that undermine a culture of safety;
  2. Recognize what is and is not “sexual harassment,” and review legal standards pertaining to an employer’s obligation to provide a work environment free from sexual harassment; and
  3. Evaluate “best practices” and key policy elements to encourage reporting of sexual misconduct and harassment and protect against retaliation.
